Search the Morgan County Court Docket

The Morgan County court docket records filings, hearings, orders, and outcomes across several West Virginia courts. A Morgan County docket search starts by identifying whether the case belongs to Circuit, Family, Magistrate, or a municipal court. Public Circuit material uses WVPASS, while Magistrate histories use a separate statewide search. To search the Morgan County court docket accurately, keep the court name and exact case number nearby, review later events for changes, and contact the clerk who holds the original file when a date, document, or certified copy matters.

Two Morgan Docket Portals

Do not treat WVPASS and MCRSearch as one database wearing two hats. WVPASS serves the Circuit side. It may let you download public filings at 25 cents per page, plus a card-processing charge. MCRSearch serves the Magistrate side. It lists case details, event history, settings, disposition fields, and document labels. The documents themselves are another matter. For actual Magistrate papers, go to the local Magistrate Clerk.

WVPASS Access Free registered search for public Circuit records; sealed and juvenile material is excluded.
MCRSearch Fields First Name, Last Name, Case Number, verification challenge, and Search.
Result Limit MCRSearch displays up to 30 records, so broad names may need narrowing.
Public Documents WVPASS may supply public Circuit documents; MCRSearch supplies labels but not scans.
Verification The Morgan clerk holding the source file confirms important dates, status, and copies.

What a Court Docket Shows

A court docket is a timeline, not a story of every fact. Filings, process, hearings, orders, judgments, and disposition events all appear in order. A charge or complaint only records an allegation. A motion only records a request. Neither one settles anything by itself. Read the later order or disposition alongside the sequence that came before it. The Morgan County docket becomes far easier to interpret.

Case Number The court-specific identifier; preserve its full punctuation and type code.
Parties Public role labels and names when access rules allow their display.
Docket Entries / Filings A chronological list of papers, notices, returns, motions, and court actions.
Hearing Settings Date, time, courtroom, county, assigned official, and setting type when entered.
Court & Judge The filing court and judicial assignment, which do not always establish hearing location.
Disposition The recorded outcome; verify it against the final public order or judgment.

Morgan Docket Number Clues

A Morgan Circuit case number usually blends the year, a type code, and a sequence. Local clerk materials identify F as felony, C as general civil, B as a bound-over felony matter, D as domestic, G as guardianship, and MH as mental hygiene. Appeal suffixes can mark civil, criminal, municipal, or personal-safety routes.

The code tells you where the file sits. It also covers its broad category. That is all it tells you. It proves nothing about guilt, liability, public access, or final disposition. Magistrate cases carry their own identifiers. The separate payment service can search by Citation ID, Case ID, or Payment Plan ID. When a felony moves from Magistrate up to Circuit, hold onto both numbers. Run a docket search in each court history.

Which Courts Keep Dockets

Morgan's trial courts split by jurisdiction. They also split by who keeps the file. The Circuit Court of Morgan County is the general-jurisdiction court of record. It sits in the Twenty-Seventh Judicial Circuit alongside Berkeley County. Family Court belongs to the Twenty-Third Family Court Circuit with Hampshire and Mineral. Magistrate and municipal courts each take their own lower-court matters. The right court docket depends on the case's level.

Court Docket Covers Where to Search
Morgan County Circuit Court Felonies, higher-value civil cases, equity, writs, and lower-court appeals WVPASS, then Circuit Clerk
Family Court Divorce, custody, support, paternity, and domestic relations Circuit Clerk; access limits apply
Morgan County Magistrate Court Misdemeanors, traffic, preliminary felonies, small civil claims, evictions, and protection matters MCRSearch, then Magistrate Clerk
Bath and Paw Paw Municipal Courts Municipal ordinance, parking, and municipal traffic matters Town court or clerk
Morgan County Clerk Probate, estates, and county administrative records County Clerk, not WVPASS

Which Morgan Clerk Owns It

The Morgan County Circuit Clerk holds Circuit and Family case records. Civil, criminal, domestic, and juvenile files sit there, along with guardianship, adoption, mental-hygiene, and appeal matters. The Morgan County Magistrate Court Clerk keeps Magistrate criminal, traffic, preliminary-felony, small-civil, eviction, and emergency-protection records. Probate work belongs to the County Clerk. That role is separate.

Transfers and appeals can create two files. A felony may begin with Magistrate events and later pick up a Circuit felony number. A Bath or Paw Paw matter can stay municipal. An appeal opens a Circuit file. The Morgan County courts directory links local court offices. The state court-record access gateway separates the public Circuit and Magistrate search systems.

Finding Court Dates and Settings

Morgan County publishes no countywide calendar merging every court. So start with the newest citation, summons, notice, order, or case history for your date. WVPASS may list Circuit events and public notices. MCRSearch can show Magistrate setting details. These include date, time, courtroom, county, judicial officer, and setting type. Bath and Paw Paw dates follow municipal instructions.

A newer notice can push an older date aside. "Hearing continued" means the setting moved, not that the case ended. A filed motion to continue changes nothing unless the court grants it. Confirm the live setting with the clerk, court staff, or your attorney. Check official court closures before you drive. The Morgan County court calendar page covers shared-circuit locations, resets, municipal dates, and missed settings.

Morgan Cases in Berkeley Courtrooms

Morgan and Berkeley Counties share the Twenty-Seventh Judicial Circuit. Several circuit judges keep chambers or hearing addresses at the Berkeley County Judicial Center. A Morgan filing can therefore carry a Morgan case number. Its hearing can happen in Martinsburg. Never guess the appearance location from the filing county or a judge's general office. Read the newest order for the building, room, date, and time. The current Judiciary county page names the circuit, judges, clerks, and official contacts. WVPASS can clash with a paper notice. Then call the Circuit Clerk or your attorney. The signed order and the court's own confirmation beat an older portal row every time.

Public Access to Dockets

West Virginia recognizes public inspection of non-exempt records. Court rules separately govern judicial files and electronic access. Public access does not put every document online. A clerk can withhold sealed or confidential material. The clerk can redact protected identifiers and hand over the segregable public portions when rules allow. That is the balance the Morgan County court docket system works within.

Key Rules:

West Virginia Code § 29B-1-3 provides inspection and copying rights, a five-business-day response framework, reasonable reproduction costs, and no general search or retrieval fee under FOIA.

Trial Court Rules 15A.25 and 15A.26 recognize the electronic register and make nonsealed public electronic docket material available through the clerk.

Civil Rule 79 requires a civil docket recording filings, process, returns, judgments, and proceedings.

Family Court Rule 6 allows public orders and indexes while restricting pleadings, recordings, exhibits, and transcripts.

Restricted Morgan Docket Categories

Not every Morgan County court docket is open search material. Sealed cases, juvenile proceedings, adoption, mental hygiene, and abuse and neglect stay restricted. Parts of guardianship files and parts of family files stay restricted. Family orders and indexes may be public. Pleadings, recordings, exhibits, and transcripts stay confidential. A "no result" reply never proves no matter exists.

Ask the clerk what is available. A public docket, public order, or redacted portion may be an option. For sensitive categories, the Circuit Clerk may require identification, in-person handling, or notarized authorization. The office limits telephone disclosure for divorce, mental hygiene, guardianship or conservatorship, and juvenile matters. FOIA cannot override a sealing order, a confidentiality statute, or a court rule.

The Clerk and Docket Records

Dockets do not live online alone. The Circuit Clerk still takes in-person and written requests and can explain how copies get routed to you. MCRSearch lists Magistrate documents but does not host them, so the Magistrate Clerk is the office that actually supplies those papers. Writing in? Give the court, case number, document title, entry date, date range, copy type, return address, and phone. Say you will pay confirmed costs.

Morgan Docket Copies and Fees

Know what you are ordering. A docket printout, plain copy, certified judgment, and transcript are four different products. Each one has a different price. The Morgan Circuit Clerk fee sheet puts plain copies at $1 per page. WVPASS charges 25 cents per page for public downloads, plus card processing. The local sheet lists no separate certified-copy price. So ask for the current total, and get transcript charges from the reporter or transcription source.

Record Product Published or Confirmed Cost
Circuit Clerk plain copy $1 per page on the posted schedule
WVPASS public download $0.25 per page plus card-processing fee
Certified copy Confirm current amount with the custodian
Magistrate document copy Nominal statutory copy fee; confirm locally
Transcript Reporter or provider quote

The Circuit Clerk takes cash or money order for stated services, and personal checks are not accepted. Confirm payment, postage, identification, and certification before you mail any funds.

Read Morgan Docket Terms

A label is not a legal outcome. Read each Morgan docket entry in sequence and find the related order before drawing a conclusion.

Bound over
A preliminary felony matter sent from Magistrate Court toward Circuit Court; it is not a final disposition.
Continuance
A setting moved to another date; the old event remains history while the later notice controls.
Disposition
The recorded outcome for a charge or case, checked against the final order or judgment.
Motion
A request for court action, not proof that the request was granted.
Electronic register
The official docket for e-filed orders under Trial Court Rule 15A.25.
Certified copy
A copy authenticated by the custodian, unlike an ordinary portal printout.

Morgan Docket Workload Snapshot

One portal cannot capture Morgan County's full caseload, and the 2025 annual report shows why. Morgan Circuit reported 82 criminal filings. Circuit civil categories totaled 150. Family added 234 filings, with juvenile categories at 56. On the Magistrate side, the civil table lists 348 small claims, 36 personal-safety matters, and 94 domestic-violence emergency protective orders, for 478 total.

82Circuit criminal filings
150Listed Circuit civil filings
234Family filings
478Listed Magistrate civil matters

These are aggregate categories, not case lists. They show why Magistrate, Family, and Circuit channels must be searched separately. Dashboards announced in July 2026 refresh daily, yet they do not replace an individual docket or certified record.

Morgan Courthouse Records Survived Fire

Morgan County's paper history reaches past any portal. Fires hit the courthouse in 1844 and again on August 8, 2006. In the 2006 fire, a vault and volunteer effort helped rescue records. A replacement courthouse opened in 2010 at 77 Fairfax Street. So a modern docket search does not exhaust the older records. Minute books, paper files, microfilm, and archival series remain. For historical work, start with the clerk responsible for the record. Note the series, date range, court, and case type. The official courthouse history, the West Virginia State Archives, and the West Virginia and Regional History Center all offer context and finding aids. Age does not remove access restrictions, and an archival description is not a certified court copy. A missing online result calls for a records-location check. It does not mean the file was lost. Did the matter begin under an older court name? Is it still in paper storage? Does an index or microfilm reel point to the original volume? Probate material sits with the Morgan County Clerk, not the Circuit Clerk. Circuit and Family files stay with the Circuit Clerk. Magistrate records use the lower-court office. That custody trail matters most when a party-name search does not reach the year or series you need.

Court Dockets by City in Morgan County

The 2020 Census table lists two incorporated places in Morgan County. Bath, better known as Berkeley Springs, counts 753 residents. Paw Paw has 410. Municipal matters begin with the town court or clerk, not WVPASS or MCRSearch. A state-law case arising inside town limits may still belong to Magistrate or Circuit Court. Read the issuing authority on the citation.

Bath Court Docket

753 residents · municipal ordinance, traffic, and parking matters use Bath’s clerk and citation instructions.

Paw Paw Court Docket

410 residents · municipal citations use the town route, with eligible appeals proceeding to Morgan Circuit Court.

Bath's official citation instructions name its Municipal Court Clerk and lay out the appearance path. In Paw Paw, the official appeal form sets a 20-calendar-day receipt deadline after the municipal court date, plus an appeal-bond process. Neither municipal route is a countywide calendar.

A 2002 renovation made the courthouse handicapped accessible, and an August 2006 fire that damaged the building's interior did not destroy Circuit records, which the vault and a volunteer line saved; the replacement courthouse reopened in 2010. The county's official pages give office hours but do not publish a parking map or public-transit route, so confirm access arrangements with the Circuit Clerk before visiting.
